After being placed in the barriers NORTH QUEEN, MR MECURIAL and HAPPY JACKS broke through the front gates. All were passed fit to run and were reloaded.
Subsequent to the event the stewards considered an application from the connections of HAPPY JACKS which reared at the start and took no part in the race to consider whether the mare had been denied a fair start.
The starter Mr O'Neil stated that he initially attempted to activate the start however the gates did not open and he than released the gates manually. Further that in the short time between the first attempt and the gates opening HAPPY JACKS reared and became cast.
Connection of HAPPY JACKS stated that they believed that as HAPPY JACKS had drawn barrier one when the starter attempted the start the mare and its rider anticipated the gates opening and when they didn't this caused HAPPY JACKS to rear.
Stewards acting under AR134A deemed that HAPPY JACKS had been denied a fair start and declared it a non runner. Stewards ordered all monies wagered on HAPPY JACKS to be refunded and all monies wagered on the event prior to the withdrawal of HAPPY JACKS to be paid as follows:- for the win, face value of the ticket less 23 cents in the dollar. For the place, face value of the ticket less 23 cents in the dollar.
